Criminal history – grounds for deportability and inadmissibility


Criminal offenses or convictions can lead to deportation or block a path to legal permanent residence.  The Illegal Immigration Reform and Immigrant Rights Act (IIRAIRA) and other legislation expanded the list of these offenses.   In some cases, actions can be taken to decrease risk of deportation or the ability to adjust legal status. Common offenses of concern:

  • Convictions for a misdemeanor with a sentence of a year or any felony offense
  • Any violation of a California law related to a controlled substance.
  • Conviction for aggravated felony including burglary, fraud, receipt of stolen property
